Terms of Use

Last updated

The plain rules for using Lutri, buying a plan, and what you can expect from us.

Who this is between

These terms are an agreement between you and Lutri (“we”, “us”) about the Lutri app, and they are the license agreement for it. By installing or using Lutri you accept them. If you do not accept them, please do not install or use the app. Our Privacy Policy explains how information is handled.

You must be at least 13 years old, or the older age at which you can enter into a contract where you live. If you are younger than that, a parent or guardian must agree to these terms for you.

Apple and Google are not parties to these terms and are not responsible for the app, its upkeep, or its support. Extra terms for each store are near the end.

What Lutri is

Lutri helps you find and group photos and videos in your own library. It builds a search index on your phone and searches it there. It is a convenience for personal, everyday use. It is not a backup, a storage service, an accounting or tax tool, or a record-keeping system, and it does not replace your Photos app or your own backups.

Your license

We give you a personal, non-exclusive, non-transferable, revocable license to install and use Lutri on devices you own or control, for your own use, under the usage rules of the store you got it from. Lutri is licensed to you, not sold, and we keep every right that is not expressly given to you.

You may not:

  • copy, modify, sell, rent, lease, or share the app, or build another product from it
  • reverse engineer, decompile, or try to extract the source code, except where the law lets you
  • remove or hide ownership or licensing notices
  • bypass or tamper with how plans, limits, or downloads are checked, including editing stored plan data, faking the store’s answers, or replacing the search model
  • interfere with the app, with the services it relies on, or with other people’s use of them

Using Lutri responsibly

You agree to use Lutri lawfully and with respect for other people. In particular:

  • only index and search photos, videos, and audio that you own or have the right to use, on a phone you own or are allowed to use
  • do not use the app to invade anyone’s privacy, to stalk, harass, or spy on anyone, or to find, collect, or organize unlawful content
  • do not use the app in a way that the Gemma Prohibited Use Policy forbids (ai.google.dev/gemma/prohibited_use_policy), because the search model comes with that policy
  • do not use Lutri where a wrong or missing result could put people at risk or cause financial or legal harm, such as for emergency, medical, legal, or safety decisions, or for tax or accounting records

Your photos and videos

They stay yours. Lutri reads them on your phone to build a private index. We never receive them, and these terms give us no rights in them. You are responsible for having the right to index what is in your library. Lutri never deletes, moves, or edits your photos and videos, and clearing the index never touches them.

Lutri does not back up your library and cannot restore anything that is lost, so keep your own backups. Lutri has no passcode of its own: anyone who can unlock your phone can search your library with it, and a search can bring up a picture you would not want others to see. Take care when you show your screen to someone else.

Plans and payment

Lutri is free to use with limits on how many items it indexes and how many results each search shows: a free install lets you run the instant demo, index up to 150 items from your library, and see the top 25 results for each search. Features such as saving a search to the Library tab and priority indexing for new screenshots are part of Full access. The current limits are shown in the app, and we may change them.

Full access removes those limits and adds the features listed on the plans screen. It comes as a Monthly or Yearly subscription, or as a one-time Lifetime purchase. Prices and applicable taxes are shown before payment. Mobile payments use the relevant store and its payment terms. When website sales are available, Stripe processes payments for Lutri.

  • Subscriptions renew automatically. Payment is charged to your Apple Account (formerly Apple ID) or your Google Play account when you confirm the purchase. A subscription renews for the same period unless you cancel at least 24 hours before the current period ends, and your account is charged for the renewal within 24 hours before the period ends. On Google Play, you can cancel at any time before the renewal date.
  • You can manage or cancel a subscription in your store account after buying: on iPhone, in Settings under your name and Subscriptions; on Android, in Google Play under Payments and subscriptions. You keep Full access until the end of the period you have paid for. Deleting the app does not cancel a subscription.
  • Switching plans. You can move between plans in the app or in your store account. The store handles any credit or charge for the change.
  • Restore purchases brings back a plan you already bought, for example on a new phone. It needs the store account that made the purchase.
  • Sharing purchases. An optional verified Lutri purchase account can link Full access across supported platforms. Sign in with the same account on each device. To link a mobile purchase made before sign-in, restore it inside the app using the original store account. This shares access, not your library. Windows support is not yet available, and a purchase does not promise a release date or support on every platform. Do not start a second subscription to move between devices; manage an existing subscription with its original billing provider.
  • Website subscriptions renew at the interval and price shown at checkout until canceled. Use Manage subscription on the website account page or the Stripe billing link in your receipt. If you cancel renewal at the end of the paid period, access continues until that period ends. Signing out, deleting an account, or uninstalling the app does not cancel billing. Contact support@lutri.app for a web payment or refund request; applicable consumer rights are unaffected.
  • Price changes. We may change prices for new purchases at any time. If the price of a subscription goes up, the store tells you as its rules require, and asks for your agreement where it must, before you are charged the new price.
  • Refunds. Payments and refunds are handled by Apple or Google under their policies, and we cannot refund a store purchase directly. You can ask the store for a refund through its refund process. Nothing here limits a right to a refund that the law gives you.
  • Taxes and fees. The store adds the taxes that apply where you live. Your bank or card provider may add its own fees, which we do not control.
  • Withdrawal for digital content. If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you ask us to start providing Full access as soon as you buy it, and you acknowledge that once it has started you lose your 14-day right to withdraw from the purchase. The store may ask you to confirm this when you pay. This does not affect your other rights, including your rights if Lutri is faulty.

What Lifetime means

Lifetime is a one-time payment that unlocks Full access to Lutri for as long as the relevant Lutri product is offered on a supported platform. Restore using the store account that bought it, or use the same optional Lutri purchase account after linking that purchase. It does not renew. Sharing Full access does not include products or features sold separately, and does not promise that a future Windows app or any other platform will be released.

Lifetime refers to the life of the product, not to the life of a person or of a device. It is not a promise that Lutri will be offered, updated, or supported forever, that it will work on every future phone or system version, or that it will include products or features that we sell separately in the future.

If we ever stop offering Lutri, we will try to say so in the app and on its store page beforehand, and the copy already on your phone should keep working for as long as your phone, its software, and the services it relies on allow. If a change we make takes away a feature you paid for, in a way that makes your plan materially worse, you can write to us or ask the store about a refund, as the store’s rules and the law allow.

What unlimited means

Where the app says Unlimited, we do not set a limit. Your phone still has limits of its own, such as storage, memory, battery, and processing time, and indexing a very large library can take a long time.

Using your plan offline

Lutri keeps a sealed record of your plan on the phone so that Full access works without a connection, and it checks with the store from time to time when you are online. A subscription that has ended, or a purchase the store has refunded, stops unlocking Full access once the app learns of it. If the app cannot reach the store for an extended period, a subscription stops counting as active until it can check again.

Downloads, data use, and your device

The search model is a large file, several hundred megabytes, that downloads once when you ask for it. Use Wi-Fi if you can: you are responsible for any mobile data charges. Indexing a library uses your phone’s battery, storage, and processor, and the phone may get warm. By default Lutri indexes while the phone is charging, preferably at night, and you can change that in Settings. Make sure you have enough free space, and keep your phone’s software up to date.

To the extent the law allows, we are not responsible for data charges, for the effect of indexing on your phone’s battery or performance, or for a download that fails because of your connection, your storage, or the hosting service.

Software and models from others

Lutri is built with software and models from other people, and each part is covered by its own license. Nothing in these terms limits the rights those licenses give you. The Open-source notices, in Settings under About and on our website, credit the main parts and name their licenses.

The search model is EmbeddingGemma 2, an open model from Google DeepMind, converted for phones by the LiteRT Community. Both are released under the Apache License 2.0. The app downloads the converted model from Hugging Face. It is not part of the app itself. On Android, text recognition uses Google ML Kit, and purchases use RevenueCat, the App Store, and Google Play. Those services are provided by their owners under their own terms, and their availability and behavior are outside our control. We are not responsible for them.

Google, Android, Google Play, Gemma, and ML Kit are trademarks of Google LLC. Apple, iPhone, and App Store are trademarks of Apple Inc. Hugging Face and RevenueCat are trademarks of their owners. Lutri is an independent app and is not affiliated with or endorsed by any of them.

Our rights and your feedback

The Lutri name, logo, design, text, and software belong to Lutri or its licensors and are protected by law. These terms do not give you ownership of any of them, or any right to use our name or logo, except as the law allows.

If you send us ideas or feedback, you let us use them without limit and without owing you anything. We do not have to use them, and we do not treat them as confidential unless we have agreed to that in writing.

Changes to Lutri

We may change, suspend, or stop parts of Lutri, including the limits of the free plan, the features of each plan, and the price of new purchases. We may also stop offering Lutri altogether. If a change makes what you paid for significantly worse, we will tell you where we can, and the sections on Lifetime and on refunds explain what you can do.

No warranty

To the fullest extent the law allows, Lutri is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that Lutri will be uninterrupted or free of errors, that it will find every photo, video, or piece of text, or that its results will be correct or complete. Some places do not allow these exclusions, so some of them may not apply to you. Your rights as a consumer under the law where you live are not affected.

Limit of liability

To the fullest extent the law allows, we and our suppliers and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost photos, lost data, lost profits, lost revenue, or loss of goodwill, arising from your use of Lutri or from not being able to use it. This includes anything that happens because you relied on a search result, a collection, a receipt total, or a duplicate grouping, anything that happens to your device or your library outside Lutri (including files you delete in your Photos app), and any failure of the stores, RevenueCat, Hugging Face, or other services we do not control.

Our total aggregate liability for all claims arising out of or related to Lutri or these terms, combined across every claim, is limited to the greater of what you actually paid us for Lutri in the twelve months before the claim and ten US dollars. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence. Some places do not allow these limits, so they may apply to you only in part.

If a claim is made against us

To the extent the law allows, you agree to indemnify and hold us harmless from our reasonable losses and legal costs if a third party makes a claim against us because you used Lutri unlawfully, broke these terms, shared a note or content that infringed someone else’s rights, or otherwise infringed someone else’s rights. This does not apply where the law does not allow it, including to consumers in places that protect them from such a term.

Ending these terms

You can stop at any time by deleting Lutri. Deleting the app does not cancel a subscription, so cancel it in your store account. We may suspend or end your license if you break these terms, if the law requires it, or if we stop offering Lutri. Parts that by their nature should continue, such as ownership, the warranty disclaimer, the limit of liability, and the governing law, continue after that.

Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change matters, we will tell you in the app or on this page before it applies, at least 30 days beforehand where we can, and it will not change what you have already paid for. If you do not agree to a change, stop using Lutri before it applies. Using Lutri after a change takes effect means you accept it.

Governing law and disputes

These terms, and any dispute about them or about Lutri, are governed by the laws of the country where the publisher named in these terms is established, without regard to conflict-of-law rules. The courts of the country where the publisher named in these terms is established have jurisdiction over any dispute, except that if you are a consumer you keep the protection of the mandatory laws of the country where you live and may also bring a claim in the courts there.

If you have a complaint, please write to us first at support@lutri.app and give us thirty days to try to put it right informally. Most problems can be sorted out quickly that way, and we will try to answer within a few working days.

To the fullest extent the law allows, any dispute will be brought only on an individual basis and never as a plaintiff or class member in a class, consolidated, or representative action, and any claim arising out of or related to Lutri or these terms must be filed within one year after the claim arose or it is permanently barred. These limits do not apply where the mandatory laws of the country where you live do not allow them.

General

  • These terms, our Privacy Policy, and the terms of the store you got Lutri from are the whole agreement between you and us about Lutri.
  • If a part of these terms cannot be enforced, the rest still applies. If we do not enforce a part, we have not given it up.
  • We may transfer these terms to someone who takes over Lutri. You may not transfer them without our written consent.
  • We are not responsible for a delay or failure caused by something beyond our reasonable control, such as an outage of a store or of the internet.
  • We may give you notices in the app, on this page, or by email if you have written to us. These terms are in English, and if they are translated, the English version prevails where the law allows.
  • Headings are only for convenience.

If you got Lutri from the Apple App Store

Apple requires the following terms for apps that have their own license agreement. They apply in addition to the rest of these terms, and if they conflict with them, these ones apply.

  • These terms are between you and us only, not Apple. We, not Apple, are solely responsible for Lutri and its content.
  • Your license is limited to use on Apple-branded products that you own or control, as the Usage Rules in the App Store terms allow, including use by other accounts of the purchaser through Family Sharing or volume purchasing.
  • We, not Apple, are solely responsible for maintenance and support. Apple has no duty to provide either.
  • If Lutri fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price. To the extent the law allows, Apple has no other warranty duty for the app. We, not Apple, are responsible for any other claim, loss, or cost caused by a failure to meet a warranty.
  • We, not Apple, are responsible for claims by you or anyone else about Lutri or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
  • If a third party claims that Lutri, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging the claim.
  • You confirm that you are not located in a country subject to a United States government embargo, or designated by it as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.
  • You must follow the terms of any third-party agreement that applies when you use Lutri, such as your wireless data plan.
  • Questions, complaints, or claims about Lutri can be sent to Lutri at support@lutri.app.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple gets the right, and is treated as having accepted the right, to enforce them against you as a third-party beneficiary.

If you got Lutri from Google Play

Google is not a party to these terms. Your purchase through Google Play is also covered by the Google Play Terms of Service (play.google.com/about/play-terms). Google is not responsible for Lutri, for maintaining or supporting it, or for claims about it. We are responsible for them as set out in these terms.
